Workshop???
Seems like the only time I have to write any more is when I'm on the road...
I wanted to talk about the "effluent disposal" workshop a few weeks ago. I didn't go but I was able to watch it on tape recently.
Here are a few observations that really struck me.
In the first few minutes Scott Lee asked a direct question. "What is the operations and maintenance cost going to be when the new plant comes online?"
Hmmm...Bert Rapp:..."well, I don't want to guess"..."I don't have the proforma..."
Barbara Smith said "I'll get you copies of the official statement(bond documents). It's in there."
So, do you mean to tell me that Bert and Barbara don't know what the O & M is going to be? Do you mean to tell me that they have spent the last couple of years poring over the proforma to figure out what rates they were going to charge and they can't remember one of the most important line items? I've only looked at it a few times and I know what it is. It's also on the Prop 218 ballot that they held hearings on.
Of course, Glenn Hille, who can usually be so helpful in providing information, remained silent when he knows exactly what the O & M is. And weren't two members of the City Council Finance Committee and Sewer Subcommittee, Steve Conaway and Cecilia Cuevas, sitting there unwilling to give Scott Lee an honest answer?
tsk. tsk.
By the way, the answer is, our total operating costs are;
$ 1,200,000 in 2007
$ 7,000,000 in 2010
$ 10,000,000 in 2014

Scott Lee asked another direct question in response to Bert Rapp and Glenn Hille saying that new development is paying 43% of the capital costs from sewer developer impact fees.
Scott said; "Do you mean the whole sewer plant - and they're paying 43% and existing residents paid 63%?
They said yes.
How can that be? I hope someone out there will look into this. If we are paying $80 MM...then 43% would be $34.4 MM.
$ 80,000,000 = 100%
$ 34,400,000 = 43%
$ 45,600,000 = 57%
But it doesn't compute because currently sewer DIF's are about $12K per unit/permit. The presumption is that there will be 46 permits per year. That equals about $550k per year and over 20 years that's only $11 MM.

ERU/YR 46
DIF REV/YR $ 552,000
DIF REV/20 yrs $11,040,000
There was more but these were the most egregious comments.
Bless Scott Lee for trying. I invite anyone out there to tell me how development is paying 43% of the sewer plant costs. The residents of Fillmore are getting fleeced and forced to build a plant so much bigger than we need...but the sizing design flaws are for another day.

Did you know that Channel 10 did not air the work shop?
It is time for an Audit and a clean sweep of all these incompetent Employees.
We the Citizens of Fillmore deserve competent, Certified Employees. Are Tax Dollars are paying their salaries and the constant error and mistakes are unacceptable.
Sounds Bert Rapp and Barbara Smith are good at juggling numbers.

I know Ristau is being evaluated, this should reflect his performance.
Also Rapp shouldn't he be Certified? An Engineer shouldn't be tongue tied when asked questions. Especially when it comes to this Gold Plated Sewer Plant.

Per Brian Sipes...
During public comment on Item 8A of tonight's Regular City Council Meeting...
Sipes: "Good evening , there is an element I want to talk about on the Code of Ethics #10, Confidential Information. This states: Members shall respect the confidentiality of information concerning City property, personal or preceding of the City. They shall neither disclose confidential information, without proper legal authorization, nor use such information to advance for personal interest. You're probably asking why I bring this up? Recently I've been informed by a "couple of citizens" in Fillmore that private information has been leaked on an internal issue, an issue that we are discussing this evening, on Ms. Walker not signing the Code of Ethics. This information was leaked to the "Cyber Highways" on October 15th and 16th 2007. To my knowledge there was not a PIR request which is a public information request, so this must lead to someone within the council and/or the City staff that has direct access to this information. This action had ill intentions along with political agendas attached for personal gain. I'm requesting that the City attorney investigate the "situation" and reprehend the individual or individuals therefore involved, thank you."

How come nobody jumps up and screams about these professionals (with our money)playing dumb? How come with Conaway and Cuevos superior intelligence cant think on their feet and demand answers? Stewie: No I'm not quite ready to remove comment moderation. I have trust issues. As far as deleting inappropriate comments, it's not practical for me right now. I've been traveling so much lately and can't depend on having an internet connection every day.
Just Fillmore Blog: Yes, thanks for pointing that out right away. The workshop was broadcast on Tuesday, November 20th. I think a lot of people try to catch the broadcast on reruns which have been blocked for awhile so maybe they thought that it wasn't broadcast.

If you are asking for me to comment, I would say that Brian is correct - that whomever solicited this information from City Staff did so with improper procedure and political ill intent.

Anonymous 7:41: That is a good question. I have missed several meetings because they have not been re-run on Wednesdays, Saturdays or Sundays. I don't know why they stopped running them. Perhaps there is a good reason.
Anonymous: 6:59: See above re: Channel 10 broadcast. I'm not sure that I would question the competence of employees. They are fulfilling their job descriptions adequately.
I question the integrity of interaction with the Council and the public. As demonstrated at the workshop, it appeared that there was a deliberate effort to evade direct questions and not provide information as requested.

I was not quick to accuse. I told the "truth", I wonder if you know the definition.
All I can say is at least my side of town did not get to see the work shop on TV.
I set aside the time, I thought it would be an interesting meeting and I was disappointed when all I saw was the Advertisement and nothing more.
I am a dedicated Ch 10 watcher. I can't make it to City Hall and this gives me the ability to watch all the functions that happen at the meetings at City Hall.
My neighbors and I were not able to watch it. Why? I do not know.
I also do not know why some saw it and some didn't.
Now did anyone else see it live or on tape?
Any one can get a tape from City Hall.
I also want to include, this was not the first time this has happened.

Sorry for the delay, I wasn’t ignoring you, I was in Mexico.
I think the City’s bulletin board is still new and people are taking a wait and see attitude. I’m hopeful things will pick up, some of the posts are starting to pick up. I never expected it to take off overnight. I am a little disappointed that none of the news sources have commented on it but I’m sure they have their reasons.
Peter; Unfortunately, my laptop has died so I am trying to post with my Blackberry which is a pain.Bear with me. I hope to start participating in the City bulletin board when I get back.
As far as the chloride committee, I did send Bert an email back in June when it was first discussed at the City Council.I expressed an interest but never got a response. That's okay though since I have a lot of other things going on.
I think the committee has some outstanding individuals;Tom Fennell, Eduardo Gonzales, Dick Schuck. I don't know the other people.
I have some info I want to share with them. I will probably post some info when we get back and I have access to a computer!
Gayle, what did you have for lunch on November 1st? Can't recall but you ordered it why can't you recall?
The point here is two fold,
1) As with any document that is being scrutinized by the public any type of misinformation can and will be used against that public entity. meaning that without the Performa or Bond paparwork sitting in front of Bert to be able to report to city council directly from the document generates liability issues. To make an educated guess, and while the guess may be 100% correct Bert has the legal responsiblity to ACCURATE to the best of ability. This means that he must read the numbers directly from the paperwork and calculations that have been conducted. For example if you were giving testimony in a court of law wouldn't it be prodent to provide information based on your notations or legal documents or based on your memory. Memory may be incorrect, but the documents do not lie.
2) With all the business being conducted in city to be expected to recall every detail of every document is rediculous. While Bert should have been prepared and had the documents he needed to provide the information to the city council readily available, he did not and that is what he should be chastized for.
Gayle did you read the Sespe Sun’s Letter to the Editor.
Talk about following the leader or double standards.
Ms Uber states she signed the Code of Ethics and demeans Councilwoman Walker. Shame on you Ms Uber.

Hi Peter. I answered your Patti question and as far as thoughts on Mr Sipes, I simply don't trust him, and I'll play it by ear in the coming months with respect to him and "the dirty dozen."
I have never personally met, Steve, Cuevas, Ken, Uber, Rodger..etc. And that is that.
I feel that the gentrification process would work well in downtown Fillmore. The low income senior apartments would have served the city better if they were downtown lofts and upscale living units. Although the aesthetic look of the building is remarkable, we simply must not continue to allow any more low income living units in the downtown district.
"A new year, a new beginning - a new political force has been born?" I was referring to the fact that in our 2008 election year, there's a possibility of the people unsuspectingly shifting political gears on the City Council to a slow growth/ no growth majority rule. We can then kiss our dreams goodbye.

I have not met Brian. The trust deficiency probably derived from the simple fact that I've never heard of the man until recently and in my opinion he seems to be very interested and eager to sue the City on various matters that otherwise benefit the city? (Sewer, housing….etc) The man is well mannered and a smart cookie but I question his motives and perspective of City Hall. How long has he lived in Fillmore?
My suggestion to Steve, Ken Uber or whoever decides to run in 08, is to reject and withdraw from developer funded campaigning and contributions. The public's trust is what will get you elected. Citizen campaign contributions and citizen volunteering is the way to go.

Uber was told to file the SEI and it took her an addtional 14 months.
It is not considered disorganization, it is intentional disrespect of California Campaign Laws.
You are only minimizing it because she is in the PAC Friends of Fillmore.

To add, the FPPC fined Uber, because the non filing was "intentional".
Okay and???? Again what does this have to do with signing the code of ethics???? Tom I know this is off topic,But what is the point of contributing to the City's bulletin board when most questions for the City are ignored? I thought the Wood Ranch question was excellent because of the city's rigid policy of wanting a business to purchase a Fillmore business license BEFORE any payment is made.Do they over look this when it convenient for them to do so?I would ask the city's bulletin but the policy seems to be... ignore it and it goes away!

Sorry, the last couple of days have been crazy and I didn’t see your post.
The city’s bulletin board is never going to be perfect but I think it’s a start in the right direction. I’m not defending but I’d have to guess the city is still trying to work out the liability of the response factor with the city attorney. The bulletin board is a tool, work within what you know is working for now and see what changes down the road.
I’m sure I’ll get blasted for this from my #1 friend out there but you can look at this one of two ways.

The fact that the question has gone unanswered?
Or
The fact that the question is still visible on the board?

I understand this is how and why the conspiracy theories get started and grow,causing division in our town.It seems to me when a simple question is a little too uncomfortable for Bill or anyone else at City Hall they need the lawyer to parse words and make their indiscretions legal for them. and thats only because they were caught not playing by their OWN rules making them seem like hypocrites or disingenuous at best.

I wouldn't hold the city's feet to the fire just yet. I think it was pretty darn brave of the powers to even consider trying a bulletin board in the first place. The board is going to take awhile to shake out, keep asking the questions!
