Bonds away
The bonds for the sewer plant have been sold.
Selling the bonds was one of the escape clauses out of the American Water contract. It's too bad that we continued with the bond financing when we could and should have been using the State Revolving Loan funds for half the interest cost.
This path has needlessly cost the ratepayers millions more than necessary.

This money should have bee applied to the Recycling Plant. We do not need to read about The Recycling Plant in Glossy Print. One entire page to remind us of the terrible decision that was made and "WE" having to pay for it!!!!

Gayle, you sound like a broken record, why don't you ask why the city council and staff recommended the bonds we currently have in place. For that matter if you are so interested in being unbiased why don't you tell us why, I am sure you know the reason. It has only been explained to you a million and a half times.
For those of you that do not know why the city council, staff, and consultants have stated it time and time again to Gayle at the city council meetings, the public workshop, and in the response document to Gayle repeated and answered questions look it up. For those of you who do not have the time here is the short and simple answer. The Bonds that Gayle is requesting the city to pursue take a long time to process, time we do not have, the end result all the saving spent on FINES and FEES for being late. Whether the LARWQCB offers an extension or not the project must move forward. Additionally, the bonds are 20 year bonds, while the savings in interest would be nice, the monthly bill for these bonds on the rate payors would be $129.00 or more per moonth, this is something that everyone including Gayle has stated that they do not want, a sewer bill for over 100 dollars a month. There are several other reasons, but these are the main two reasons.
Suggestion Gayle, stop asking the same question over and over and over and over and over and over and over and over again. Stop costing the city and its citizens more money that could be spent on reducing the rates by asking the same questions over and over and over and over and over and over and over again. Start trying to find feasonable and reasonable solutions. Mainly lobby our legislature and the federal legislature for financial assistance.

CCU All that happened was in essence was that Patti was against the Heritage Valley Project and she wrote a letter to the Elton Galegly and I believe other representatives at the state level. The problem arose when she signed her name Patti Walker Fillmore City Councilwomen. The reason was that the city council already passed the project, but that she sounded as though she was representing the city council with her letter, when in fact she was not. This is were all the problems stem from.

Every other city uses SRLF loans. That's what it's for. If timing was an issue, we should have had applications in a long time ago.
The difference between 20 years and 40 years would have added $3.50 a month to the monthly rates. Well worth saving close to $50 million.
My question to you is this...are you so blinded by hate that you think squandering $50 million in ratepayer money - our money - is not worth fighting for? Have you never heard of accountability?
Also, Patti Walker has more integrity, honesty and character in her little finger than all the "friends" have collectively.
Ironically, she doesn't waste her time badmouthing the "friends". In many conversations with her I've never heard her spew out trash and hatred like you people do.
The only thing patti HAS managed to spew out is lawsuits, lawsuits and more lawsuits. Not to mention violating the city's code of ethics agreement. She has also managed to become the only Fillmore council member in history to be censured by her fellow co-council. That's pretty ironic for a person of integrity.

Gayle nice try, but the estimates that the city staff and the consultants have stated in the letter to your questions was that the rates would be more than $129.00 PER MONTH, THIS IS SIMPLE MATH it is not 3.50 more per month. Also, Maybe the city should have looked into the bonds long ago, but as you have stated time and time again they needed to have a plan in place, competitive bidding, etc... in order to even apply for the bonds, until this last year not everything was in place, thus they couldn't have applied. The competitive bidding did not occur until 1- 1.5 years ago. But than again you do not believe that they did competitive bidding so if we believe you they cannot even apply to this day.
AGAIN the problem here is the time it takes to obtain the loans will cost us any saving we will gain. While PATTI elected to obstain from one of the most important votes the city council has faced, by the way this truly shows how much she cares about you and the city, she does not even vote, what a joke, at any rate the city council, staff, and consultants are taking a long hard look at all options, and while you may dissagree with them, the options that you have put forth seem to be only costing us more in the long run. AGAIN, LOBBY our legislature and get funding for our project. Unit and call them, write letters, not just once but as many times as it takes, and do not walk away with an empty unfunded promise that they will introduce a bill that does not accomplish anything other than lip service. I call them frequently in an effort to get something done, and while I am one person, if we unit we can get the funding

Interesting comments, but Gayle, as you have seen time and time again you are looked at in poor favor when speaking to a large audience to public officials, I genuinely do not mean any offense to this comment as it is meant as constructive criticism. I know for a fact that you write well and articulate your comments with proper grammer and spelling.
everytime I have watched you make comments on TV you seem to be very nervous, alloof, disorganized, and unable to put your thoughts together in a manner that causes the articulation of your points to become confusing, disjointed. I have watched time and time again as the city council and staff look at you and have a difficult time understanding you and following your thought process. While you comments are very detailed, they do not shock and aw the people you are speaking to in order facilitate their empathy and concern with your points.
Suggestion, find a person that articulates their point in a manne that will capture the audience and those you are speaking to. This will help you with your plight and actually might accomplish your goals for ya.

anon 3:17: Thanks for the feedback. There is no offense taken. My expectations for my speaking ability are not that high. I don't expect myself to win any awards. I'm just trying to do what I can. up until a year ago I had never attended a City Council meeting. Talk about confusing - the proceedings can sometimes be difficult to follow and understand. I think that keeps a lot of people from participating.
Anyway, reflecting on your comments("the city council and staff look at you and have a difficult time understanding you") one thing to realize, is that I did get involved at the (next) to last hour when the costs and details of the contract started coming out(noticeably not until after the last election).
At every meeting I made the mistaken assumption that the council members knew as much technical information, if not more, about the sewer plant than I did. I assumed they had knowledge of processes, costs, technologies. I assumed they knew the differences - the pros and cons - between MBR, activated sludge and oxidation ditches(or UV disinfection-haha!). I thought they had knowledge of Government Code 5956 for procurement. I thought they were familiar with SRLF application policies.
My expectation was that they had the ability to listen to my comments and question the points that I was making and ask pertinent questions of Bert or the consultants.
I assumed that they had done research on the pros and cons of DBO (what a con job for us as it has saved nothing-why do we need Boyle to manage a guaranteed DBO contract?). That they had been briefed on the privatization issues. That they had been briefed about American Water tactics and performance in many other cities - good and bad. That they understood that yes, maybe MBR could produce clean water(however, the difference is miniscule and not worth the added expenses)but it may not be appropriate for us.
No one had ever done any cost comparisons during this entire process - until I asked for one!!(repeatedly)
They mistakenly did believe that Boyle Engineering and Bert Rapp had made the best decision for the city. I am more convinced than ever that they have not.
In all of my correspondences with Bert Rapp I made the reasonable assumption that if the costs differentials and benefits of different technologies were pointed out and backed up with documentation that reason would prevail and we all had a common goal to save our taxpayer/ratepayer monies. I was wrong about that.
There has never been an intention of saving the ratepayer's money. You need to understand that this entire project is out of the ballpark in costs to profit Boyle Engineering and American Water.
Also factor in the challenge of conveying important technical or financial information in 3 minutes. If I had unlimited time to make my various points like a council member, staff member or consultant, I could put together my slide show and discuss each slide in detail(with illustrations and charts) making sure everyone understands.
I have a feeling that the only ones sitting around making fun of me are those who have some other agenda(profit/personal politics) and no interest in questioning the points or picking up the phone to say "Gayle, what about this?" "What does GC 5956 have to do with anything?" "Tell me more about PERC water or Vertreat?" "Can I see the tables that talk about electrical use of MBR?" "Can we meet with the engineer/farmer in Santa Paula who has coordinated the NPDES permit for their ag association and says that the river discharge issue costing more than SDI is a lie?"
In regard to Dorsey's comments, all I can say is that the LARWQCB board and staff understood what I was talking about and were able to immediately respond while I was still standing at the podium.

The state does not require that"everything is in place". It is all done in a phased approach and they are aware of the process. Again, EVERY other community is taking advantage of this money - that's what it is for!

Rather than use the state's resources, we chose to use Boyle Engineering to administer and manage the project for additional millions. Hence, a $23 million project has turned into an $82 million plus project.

Sorry I didn't get to these questions sooner. When the comments are coming in too fast I can't keep up. Anyway I will try to answer your questions assuming that you are truly curious.
Okay, here is a sample of proof. Tracy/Mountain House, CA developer Trimark, just paid $15.5 million for a 3.3 MGD PERC sewer plant. They intend to turn it over to the city. (interesting how the costs go down when a private enterprise is paying for it)
We could have had a PERC system for $15 million. A proposal was submitted 5 years ago. What happened to it? Well, evidently, the RFQ/RFP had to be written next to get a fixed bid but for some reason the RFQ/RFP(527 pages) was written so that a PERC system couldn't be bid.
Now if there was a possiblity to save us MILLIONS that RFP should not have been so overburdensome. The RFP was a little too detailed for a real DBO(Design, Build Operate) contract. DBO is an "all in one package". All you have to do is write a 10-20 page RFP detailing your requirements.
That's all I have time for now but I encourage you to pick up the phone and call those with the answers such as the EPA, LARWQCB/SRLF/Infrastructure Bank, DOG,vendors, engineers, etc. If you would like their contact info or to see the pages and pages of notes I have send me your email address. Trust me - I didn't make this stuff up.
p.s. I would also encourage you to read Government Code 5956. We really didn't even have to do an RFP. We could have "competetively negotiated" a price with any vendor who brought a proposal.

But that's besides the point. PERC water WILL build an MBR for a few dollars more. They just don't know why you would want to. It's overkill for our needs.

Council Meeting last night:
Gayle, I enjoyed the great letter written by Bob Stroh, Ralph Reese read it very articulately. He is a great speaker.
I was glad to hear that finally Conaway's trip to Washington and being on American Waters Panel was addressed in the Public's eye.
You noticed, Conaway ignored it though. That was respectful of him though. If Villegas was still on the Council, he would have interrupted Reese and insulted him. At least Conaway did accept it and went on.
9:22 am: When I say "Competitive Bidding" I am referring to the business term, not just the generic words.
If you research DBO you will find that there is a distinction between bidding types - even within the DB realm.
Competitive Bidding is considered conventional procurement while DBO is considered alternative procurement.
The state waterboards also distinguish the two since their application process requires the conventional type of competitive bid. They will fund DB projects but they have not taken the leap to fund DBO projects yet.
They are consdering it. However, currently they do not want to use taxpayer and government funding to provide profit from a public utility to corporations.
I suggest that you read this document if you want more information on DBO. Please study the findings in the report.

I would say I have asked them to reconsider a sewer plant decision. I have read a lot of statements but none of them have maligned the council. I have no desire to participate in any personal attacks. We're not in Jr. high school anymore.
On the other hand, you have made an extreme effort to malign me, Patti Walker and Brian Sipes. But you hide behind anonymous.
I also have stated many times that I thought our staff have been polite and professional in my experience with them.
When I first became involved in city business I made attempts to defend council and staff members and keep an open mind. I still do.
Now there are other people here who perhaps have not had the same experience. There is a lot of anger out there. I hear it a lot. Why is that? I was out of town for many years and missed a lot of this history but something has happened to create that anger long before I returned.
I can see myself that the changes that people are angry about have not benefitted members of the community. They have watched the quality of life deteriorate and now it is accelerating so fast it's in their face every day. I do not blame them for being angry.

Get off the competivite bidding binge. When a RFP is published, anyone can respond who can meet the criteria. What's so un-competive about that? That's the real world that yout sheltered corporate types can't comprehend.

1. Any Title 22 tertiary treatment plant can and will be used to treat any future requirements. The experts(at other municipal plants) that I have talked to said they would just add R/O to their existing filtration system. But it's a moot point anyway. How do you know what future technology will be designed for future requirements?

Gayle, these people are in the know, in other words they are able to predict to within a reasonable degree what the future may intail. Again, if you are so much into research why not talk with boyle engineering and/ or Bert Rapp. Remember you are not an engineer and should not pretent to be by thinking that by doing a little research that you are an expert, you simply are not. Nor am I but I do listen to the experts and draw reasonible knowledge from what they state. While I agree that we need to scrutinize the information being presented. But to assume that because you spoke with one or two salesmen that you now know all about the subject is rediculous.

Whats the difference between a paid salesman and a paid consultant?I don't think either one can be objective their views are more subjective than anything else.
Ah good point, however, one is an expert in their field and one is an expert at selling something. An example, a car salesmen is trained in closing a deal and highlighting their product, yet a mechanic may be biased in their product (ie ford, chevy etc...) but they are also an expert in the repairs of cars. Thus, they would be more likely on making recommendations based on their knowledge of repairs of vehicles rather than on selling the vehicle on their lot.
For Gayle she seems to only be dealing with the salesmen not the experts.

I've known Roger Campbell for over 50 years, and find it hard to believe that he would not come forward on this blog to defend himself. The "MR. CAPPS" and childish "uuuuuuu" does not sound like something Roger would write. Why do you think it's Roger doing this? Maybe it could be someone else just wanting you to think it's him.
If its not Rodger,its his friend. You are known for the company you keep.Especially when they don't help you from making an ass of yourself.Even if it was Smeadly,their cheerleaders are not friends.I personally feel Rodger and Smeadly are of the same mind.Its hard to figure out the difference between the two on this Blog.
