Thanks to some readers giving me a heads up on some of the "cussin" going on around here. I have deleted the most egregious comments. I'm not here to babysit so just stick with the issues please. If you mention a person's name with an accusation make sure you have facts to back it up. Stop with the innuendos or false accusations.
Now, while some of you have been distracted by the spats, I've been continuing to research the sewer plant issue. I do want your feedback and input on the sewer rates. Our future could be literally going down the toilet. We'll be in debt to the eyeballs for 30 years and our credit rating is shot.
There has been a raging debate behind the scenes on the merits(or demerits) of alternative technologies than MBR. My goal is to have an objective technical review. Of course the City wants to make sure we have reliable wastewater treatment. But all of the technologies out there represent a level of reliability. What we're paying for is a Hummer when what we can afford is a Toyota. Is a Toyota less reliable? NO. Does a Toyota get you there cheaper? YES.
Until I get back, here's some reading for you. Don't be intimidated by this stuff. It doesn't take multiple degrees to understand.

Gayle, your second link does not work, I am curious though, when you talk of false accusations wouldn't this include a statement about the city's credit? how do you know that the city's credit will be ruined? It seems that this is one of those false statements without the backing that you spoke of. Second, while it is nice that you are doing research, it is probably to little to late, the city has a time line in which to get certain things accomplished, to start the process over again would create a major problem in meeting the time lines set up by the LARWQB, not to mention you have not included ANY information from Bert Rapp, the city council members, or Tom Ristau about why they are proceeding with their current plans. Since we both know that you do not have a degree in engineering and have difficulty understanding or comprehending city planning or engineering, I would appreciate it if you could back your statements up with some FACTS and not assumptions, assertions, a general waste of everyones time in what is your perception of what needs to occur when in fact you are not qualified to make this determination.

At the "workshop" Monday night, I asked Bert about our debt ratio and if our future borrowing potential would be jeopardized. He indicated that borrowing $60 MM would indeed jeopardize our future borrowing potential. The bonds are for 30 years. In 2008 our TSO will be reheard for chlorides and boron. We will probably get a 5 year extension before we have to get the Reverse Osmosis or other chloride/boron/etc. removal process up and running. This will cost another $40 million in today's dollars. He didn't know the exact debt ratio as Barbara Smith has that information. With $100 sewer bills at that point, how likely will the public be able to add on another $100? (Bert said with R/O right now we'd be looking at $198/month).
As far as the LARWQ time line, they would be likely to grant an extension, particularly for such an impacted community and if we are earnestly pursuing meeting compliance. The draft Santa Paula proposal indicated a timeline of 10-14 months. Is it possible that changing could get the project done faster? I'm just questioning.
The City has made their case as to why they are proceeding with their current plans. They are legitimate reasons absolutely. We need to be in compliance with a new sewer plant. They have recruited the most prominent special counsel and engineering companies in the in this area. They have to trust the engineering expertise and they do.
However, that does not preclude me from questioning alternatives. And although I have done a lot of engineering work I am not an engineer. But, I have done some due diligence in research and getting opinions from those who are much more qualified than I am. That's why all I would ask is an independent technical and cost review(value engineering study). If that could save us millions of dollars why wouldn't that be a prudent thing to do with the public's money?
Please give me an example of a statement that is not a fact? If I make an assumption I try to state that it's my opinion only.
As far as my understanding of city planning or engineering, as a member of the public I'm not required to understand all the technical details. I'm required to voice my opinion and question the use of taxpayer funds. However, I do understand that city staff, including planners and engineers are doing what they are trained to do, which is once they get the General Plan to start implementing the design, just like a general contractor would implement the designs of a building. I do not fault them for their work. But, the community at large, as stakeholders, have to be a partner in the decisions.
You have a good point about timing. I'll address that with this EPA document.

2.3.6 Public Involvement
Public involvement in environmental decision making is not only wise, it is mandatory. The National Environmental Policy Act of 1969, the Clean Water Act of 1977 (PL 95-217), and the Resource Conservation and Recovery Act of 1976 (PL 94-580) all require public involvement mechanisms and activities. Acceptance of the project by residents of the community and a working relationship between the public and the design team is essential. Experience has shown that programs are more easily accepted if the public understands what they are.
The relationship between the design staff and the public is similar in many ways to that between the design staff and the advisory committee. The public also serves in a policy-making and review role; it should be made aware of all aspects of sludge management alternatives and should provide criticism and guidance to the design staff. A means of educating the public and creating a dialog between the public and the design staff must be established. Mechanisms for accomplishing this are the mass media, bulletins, public hearings, and presentations to interested groups.
Special efforts should be made to involve groups and individuals who, from past experience, have demonstrated an interest in environmental affairs or those who are likely to be directly affected by the proposed project. Developing a list of interested persons and organizations for formal and informal notifications and contacts is a good way to ensure public participation.

la dodgers: December 21st is the public hearing. There is no special election. If you protest the rate increases you have to write a letter to the city saying "I protest the sewer rate hikes", or you can do the same at the public hearing.

I don’t like $100 sewer bills either and I commend you for getting involved. But you have a few things you haven’t mentioned.
The sewer plant problems and new discharge requirements have been known for some yeas. The city has known, the press has known. Where have you been?
The cost is a shocker but that can be said for many citys across the country: water ain’t cheap – coming or going!
Waste water is a long term problem and I’m not sure a technology as you are talking about is the answer. It may be in some locations under certain conditions, but will it meet the standards Fillmore is obligated to comply with?
If it doesn’t, that’s a really big risk. Spin wheel for Red 21?

This would be like trying to do brain surgery on yourself. the interesting aspect of this is that you say you do all this research, but than you say you do not have to understand the technical aspects of it. This makes no sense to me.
As for the public involvement, again the public is offered the opportunity to be involved, but a good majority of them do not choose to do so. This is one of the challenges of being a public official or city employee. it is kinda of like you are dammed if you do and dammed if you do not.
I would offer this, question, make suggestions, presents fact, unbiased facts that is, and than offer the statements of those involved in projects as direct quotes. What you seem to be doing is presenting information and than downplaying what you are presenting. In journalism this is called pyrimid writing, get the shocking headline out and than present details later in the story. The example of this is your comments about the credit of the city. The future borrowing potential has nothing to do with the city's credit, it has to do with its accounts receivable versus accounts payable ratio. In other words how much revenue is comming in and how much is going out. If the city is paying to much out for Bonds, loans ,etc.. this has a direct affect on how much it can borrow. This is NOT bad credit. But those words scare people unneccessarily. The referendum is another example of this, sewer bilss at 198 a month is another example. every city staffer and council member has stated that they are making great efforts to keep the bill to 100 or less, the reverse osmosis project is a seperate issue, this is for the water hardness of the city and not the treatment plant. From what I heard several city council meetings ago this project was quashed until further notice, even though the rate payors voted for the project.
The point is scar tactics only create problems and as a person that is presenting information and can influence others, I feel that you must be more ethical in your presentation of information, otherwise the ClaireK of the world will only be given more amunition to create gossip and strife in this community.

The $100 sewer bills are just until 2009. After that they go up 4% per year or the CPI, which ever is greater. Between 2005-2014 - ten years - sewer revenues from ratepayers goes from 1.5 million to $9.4 million(according to the table). So in that ten year period a minimum of $66 million will be sucked right out of our pockets and out of our community. Where will that come from? Do we know what the GDP of Fillmore is? I don't know if you can even measure that for a city, but I would guess that for a community our size, there isn't an average of $6.6 million a year available to come out of the local economy. How will the local business people survive, much less individuals?
You are right about the problems and discharge requirements being known for some years. So why did we continue to add more houses making the problems worse? Why did we drag our feet for so long?
I have not been part of the process since I was living in Colorado. During the recent campaign it wasn't in the top three issues for people. I just do what I can.
According to the draft proposal that Santa Paula got the technology is supposed to produce Title 22 water quality and meet the LARWQCB standards. For the $82 million we are paying we're not even doing that. We will still be out of compliance for chlorides and boron with another TSO coming up and no money or bonding capacity to pay for that.
The low cost stuff is working in Homer, Alaska and it and the industrial plant in Corona both won EPA awards for consistent, high quality water standards. It should be worth a look. And if you want to talk about risk, what's the risk of draining the community just so we can be cash cows.

I didn't say that I don't understand city planning or engineering. I just said I'm not required to. But I do, and I will comment and try to inform the public if possible. Maybe city planners and engineers need to understand a little common sense too and start treating taxpayer money like their own budget. I see DHW has another open ended contract coming up for approval. Cha-ching$$. Did you read the Mass Inspector General Report about those open ended legal contracts? .
It is difficult to get the public involved. Most people are busy with their lives, working and commuting so there is no time. However, there are people who can be involved and I am one of them.

Now that doesn't make any sense. Of course it does. But, instead of credit I should have said debt ratio.

You are just getting too picky here. The bottom line is with a high debt ratio we cannot borrow more money - not at market rates anyway. Just like anyone else who is in too deep of debt.
As far as scaring people unnecessarily what about the scare tactics being used on ratepayers...the liens like Los Osos - which is nothing like our situation at all. And what about the scare tactics of the regional water board fining us? We are going to be fined anyway. There is a line item in the budget for the next ten years to pay the fines. I talked to the state waterboard finance director. He said Los Osos was a septic tank conversion that had been mandated DECADES ago. He said that the waterboard was looking for a "good faith effort" to comply.
Also I believe the R/O add on is to treat the chlorides, boron and potential higher standards. The water softening is another huge capital expense and the technique has not been identified yet.

Deep Fried Twinkies are fun to eat for breakfast or at your local council meeting.
INGREDIENTS:
4 Twinkies
1 cup flour
1 tablespoon malt vinegar
1 teaspoon salt
1-1/2 cup water
PREPARATION:
Chill Twinkies. Completely combine other ingredients. Dip Twinkies in batter and fry in hot oil in deep fryer. Only cook until golden brown about 1 or 1-1/2 minutes.

I find it curious that most city employees live outside of Fillmore, so why would they care if our rates go skyrocketing?

Ojai is not a gem! They have a huge drug problem in the schools that they refuse to acknowledge and a growing gang problem that they are treating in a similar manner. If you ignore it, maybe it will go away.
your right , ojai isnt a gem. our town has huge gang problems, drugs ,and teenage pregnancy is another problem .
the fillmore city hall is another story.
I am amazed the more enlightened blogaratti (troglodytes) have not stumbled on the obvious solution to everything wrong about Fillmore: demolish city hall and put the Homer sewer plant there.
Then the out of town city people would have to find real jobs, the building dept couldn’t give out building permits for more homes, and the sewer plant could become the newest tourist attraction!

granny: There will not be another workshop. On December 21st there will be the protest hearing only. Those who protest must send in a letter to the City stating that they protest or else turn it in at the hearing on the 21st.
Several people have told me that they didn't get the worksheets on the sewer ratest. Did everyone here get theirs?
My biggest concern about the rates is that our economy doesn't have an extra $2MM next year to go to sewer rates. That amount increases rapidly so that by 2014 $66,000,000 will have been "flushed" down the toilet and out of our community. Hard to imagine. Check the numbers on the tables in case I'm not adding it up correctly. It's in the "Revenue without DIF's" row. Unfortunately I don't have a solution. Maybe a package plant...I don't know.
I do think Ojai is nice. They have made it a nice tourist destination. They have a high sales tax rate without chains. A lot of that though is from the Ojai Valley Inn. We need an attraction like that.
Double Fudge Kahlua Brownies
Categories: Desserts
Yield: 18 or 1 Servings depending on how you look at it.
4 ounce Unsweetened chocolate
1 cup Butter
¾ teaspoon Black pepper
4 Large eggs
1 ½ cup Sugar
1 ½ teaspoon Vanilla
⅓ cup Kahlua
1 ½ cup Sifted flour
½ teaspoon Salt
¼ teaspoon Baking powder
1 cup Chopped walnuts (toasted)
Line bottom of a 9 x 13 inch baking pan with cooking parchment. Melt chocolate and butter with pepper over low heat. Beat eggs with sugar and vanilla until blended. Stir in cooled chocolate mixture, then kahlua. Resift flour, salt and baking powder into mixture and stir until blended. Add nuts. Turn into pan. Bake in 350 degree oven just until pick inserted in center comes out clean, about 25 minutes (be careful not to overbake). Cook, then spread top with QUICK FUDGE FROSTING. Sprinke with additional nuts, if desired. Cut into squares or bars.
QUICK FUDGE FROSTING
Melt 2 squares (1 oz each) unsweetened chocolate and 1 aquare semi-sweet chocolate with 2 tablespoons butter over low heat. Heat 3 tablespoons kahlua and 2 tablespoons heavy cream together. Combine chocolate and kahlua mixtures with 2 cups powdered sugar (free from lumps). Beat until well blended and thick. If necessary, beat in a little extra powdered sugar for good spreading consistency. Frost brownies immediately as mixture stiffens upon setting.
Gayle, Again you miss the point, the city needs to sue the LARWQC board for the costs of their illegal mandate, the rates over the next ten years past the next rate increase will be offset by, guess, give up, growth, that’s right the cost spread out over new development will decrease our rates, for years we have known that this was coming, but we did not and do not have the capital to make spend, how do generate the capital, that’s right you increase your tax revenue, how do you do this, in a city you increase commerce and home numbers.
As for the difference between BAD credit and poor debt to income ratio there is a HUGE difference, one spurs fear while the other is an economic term that is used to express a city's or states ability to find good interest rates on loans or bonds, with bad credit you do not even have the ability to get a good interest rate because you will not qualify for a loan.
As for city staff, I would say that they care because they are not interested in dealing with the rage this community in capable of generating, are they perfect by all means no, do they make mistakes yes, but by the same token they are paid to do a job and are held accountable by us the people that pay their salaries, and if we are not happy, than they will definitely not be happy.
As for your comments that you do and will make to inform the public, please how can you make a comment or statement without understanding the information? Do you also consult on brain surgery, I hope not. All that I am saying is that you are in the public eye and people take your comments seriously, thus you have the ethical and moral obligation to present information that is factual and empirical, if it is opinion than say so, if it will create fear than dilute it with opposing opinions or present the full amount of information without drawing conclusions of what you do not understand. Your comments thus far have a fatal flaw in how the information is presented that will only generate anger, animosity, fear, misunderstanding, mistruths, etc… Because you have power now you need to use it to achieve your goals, but if you are the moral and ethical person that you say you are you need to stop abusing the power some of the citizens of Fillmore have given you.
